The Changing Face of Dispute Resolution in the UK
Speaker: Dominic Helps, Shadbolt & Co.

Organisations
Dominic Helps is a partner in Shadbolt & Co. and specialises in the
handling of all sorts of building and civil engineering disputes, both
domestic and international. Cases on which he has worked include the Tsing
Ma Bridge, Heathrow Tunnel Collapse, the Broadgate development and MEPAS
tunnel dispute. Also acted for major German contractors on a number of
substantial ICC Arbitrations and other disputes. Acted for parties involved
in adjudication and on enforcement of adjudicator’s decisions. Involved in
many of the reported enforcement decisions including
Edmund Nuttall Ltd. v R G
Carter Ltd. Dominic is a regular contributor to the construction and
legal press and speaker on construction law. Co-editor of Construction Law
Journal and accredited adjudicator for the Technology and Construction
Solicitors Association (“TeCSA”).
The advent and popularity of Adjudication as a means of resolving
construction disputes taken together with the introduction of the new Civil
Procedure Rules has caused all involved to re-think the process of dispute
resolution in the UK and a great deal of cases concerning both have been
through the courts. This does not mean that Arbitration has been ignored and
many of the decided cases have concerned Arbitration or have a significant
impact it including when a dispute is crystallised, the correct way to
apportion costs and apparent bias of the tribunal.
